Terms of Service
Last updated: 21 October 2026
1. Who we are and what these Terms cover
SweetFarewell (the “Service”) is operated by Gael Genet, Langgasse 49, 8400 Winterthur, Switzerland (“we”, “us”). You can reach us at support@sweetfarewell.com.
These Terms apply to every use of sweetfarewell.com and to every person who creates an account (“you”). They apply together with our Privacy Policy. By creating an account and ticking the acceptance box, you agree to both. If you do not agree, do not use the Service.
2. The service
SweetFarewell lets you write a private message, link it to one of your flights (flight number and date) and to one contact person, and have it delivered to that contact only if the flight has an accident that we confirm under section 6. If the flight lands safely, nothing is delivered.
• Not a will. A message has no legal effect on your estate, your inheritance or any other legal matter, and it does not replace a will or any other formal document.
• Not a safety or emergency service. We do not track your flight for you, we do not inform your relatives or the authorities, and you must not rely on the Service for urgent or time-critical communication.
• Who can read your message. We do not read messages as part of normal operation. They are stored in our database and are technically accessible to us and to our hosting provider. We access them only to operate or deliver the Service, to deal with a legal obligation, or to protect our rights.
3. Your account
You need an account to use the Service. You must give accurate information, keep your password confidential, and you are responsible for everything done through your account. Tell us immediately if you suspect misuse.
There is no minimum age to use the Service. If you are a minor, or if you lack the capacity to enter into contracts under the law that applies to you, you may use the Service, accept these Terms and buy credits only with the consent of your parent or legal guardian, who is then responsible for your use.
4. Credits and payments
Activating a Farewell costs one credit per flight. Credits are sold in packs through our payment provider Stripe. The price and currency are shown before you pay, and include taxes where the law requires it. Credits do not expire while your account exists.
All purchases are final. Credits are not refundable and cannot be exchanged for money. This applies to unused credits, to a Farewell that ends with a safe landing and therefore delivers nothing, to a cancelled or changed flight, and to a deleted account.
If mandatory consumer law gives you a right that cannot be excluded by contract, such as a right of withdrawal or a right to a remedy for a defective service, these Terms do not affect that right.
We may adjust prices and packs for future purchases. Credits you have already bought keep their value.
5. Creating a Farewell
A Farewell consists of a flight, a message and a contact. You give the flight number and date, write the message, and enter the contact’s name, mobile phone number with country code and, optionally, email address. You then activate the Farewell with credits.
• Flight data. We check your flight with a third-party flight data provider. Schedules and statuses can be incomplete, late or wrong. A successful check does not mean the information is correct.
• Saved library. You can save messages and contacts to reuse them for later flights. They stay in your library until you delete them.
• Your input. We use the contact details exactly as you enter them. You are responsible for checking that they are correct and up to date.
• After activation. Credits are spent when you activate a Farewell and are not returned (section 4).
6. When a message is delivered
We deliver a message only if both of these conditions are met:
1. A confirmed accident. The flight named in your Farewell has had an accident that we consider confirmed on the basis of official documents or reports, such as statements or reports of the airline, the airport, aviation or investigation authorities, or reliable news coverage.
2. You are among the victims. Where an accident is confirmed and no survivors are reported, we presume that you did not survive. We do not verify this person by person. If survivors are reported, we deliver only if official sources identify you among the victims.
We decide whether these conditions are met, in good faith and with reasonable care, on the information available to us. We may decide on early or incomplete information, and we may wait for further information before deciding.
How we deliver. We send an SMS to the contact’s phone number and, if you gave one, an email. Both contain a link to a private page where the contact reads your message. We make reasonable efforts to reach the contact, but we are not obliged to look for the contact if the details are wrong or unreachable.
No delivery in other cases. We do not deliver if the flight is delayed, diverted or cancelled, if it lands safely, or if we do not consider the conditions above to be met.
7. What we do not guarantee
The Service is provided “as is” and “as available”. In particular, we do not guarantee that:
• a message will be delivered, or delivered at a particular time. Delivery can take hours or days, because we wait for official information;
• the flight data we receive from third parties is complete or correct;
• the Service will be uninterrupted or free of errors;
• SMS and email providers, mobile networks and your contact’s device will deliver or display the message.
A message may be delivered by mistake. Reports can be wrong, and a flight can be wrongly identified. A message may therefore reach your contact although you survived, or although the accident was different from what was first reported. By using the Service you accept this risk.
8. Your responsibilities and content rules
You are responsible for your messages and for the contact details you enter. You agree that:
• your message is lawful, and does not contain threats, harassment, defamation, hate speech or anything that infringes the rights of others;
• you are entitled to give us your contact’s details for this purpose, and you have a legitimate reason to send this message to that person;
• you will not use the Service to deceive anyone, to cause alarm, or to simulate an accident;
• you will not misuse the Service technically, for example by automated access or by attempting to get around its limits.
We do not check messages in advance. If we learn that a message or an account breaks these rules, we may delete the message, suspend the account, and refuse delivery.
9. Contacts and personal data
We process your data and the data of your contact to run the Service, as described in our Privacy Policy. We use your contact’s name, phone number and email only to deliver your message, and not for marketing.
To provide the Service we use these providers, who receive only the data they need: Bubble (hosting and database), Stripe (payments), SendGrid (email), Textbelt (SMS) and AeroDataBox (flight data). We may change providers; the Privacy Policy lists the current ones.
10. Retention and deletion
After a safe landing. Thirty days after a flight has landed safely, we delete the copy of the message and the contact details attached to that flight. Your saved messages and saved contacts in your library are not affected and stay until you delete them.
Other flights. For a flight that never lands in our system, for example a cancelled flight, the copy stays until you delete the Farewell or your account.
After a delivery. If we have delivered a message, we keep the delivered copy and the delivery record for as long as needed to document the delivery and to deal with claims.
Deleting your account. You can delete your account in Settings at any time. We then delete your account, your flights, your saved messages and your saved contacts. We keep payment records for the period the law requires, which is currently ten years in Switzerland. Unused credits are lost (section 4).
11. Liability
To the fullest extent permitted by law, we exclude all liability for any loss or damage arising from the use of the Service. This includes non-delivery, late delivery or mistaken delivery of a message, errors in flight data, interruptions, and failures of third-party providers, mobile networks or devices.
This exclusion does not apply where the law does not allow it, in particular to liability for intent or gross negligence, for injury to life, body or health, and to liability that cannot be excluded under mandatory consumer or product liability law.
The Service is a personal message service. You accept that no amount of care can guarantee that a message reaches a particular person at a particular moment.
12. Suspension, termination and changes
You may stop using the Service and delete your account at any time. We may suspend or close an account that breaks these Terms or the law, with immediate effect where the breach is serious. Credits on a closed account are not refunded.
We may change the Service and these Terms. For a change that affects you, we notify you by email or in the app before it takes effect. If you do not agree, you can delete your account before then. If you keep using the Service after the change takes effect, you accept the new Terms.
13. Governing law and jurisdiction
These Terms and the Service are governed by Swiss law, excluding its conflict-of-law rules. The courts of Winterthur, Switzerland, have jurisdiction, unless mandatory law gives you the right to bring a claim, or requires a claim against you to be brought, at your place of residence as a consumer.
14. Contact and legal notice

If a provision of these Terms is invalid or unenforceable, the rest remains in force, and the provision is replaced by a valid one that comes closest to its purpose. These Terms are written in English. A translation is only a convenience, and the English text prevails.
